These songs are called "iTunes Plus" songs surrounded by the iTunes store, and they cost 99 cents, which is 10 cents more than the DRM protected songs.
Both song files are AAC format. To see if it is a non-DRM file once you download it, purely select the song, right click and select "Get Info", then look at the summary skylight. In the "Kind" field, the protected songs are labeled as "Protected AAC Audio File" and the unprotected files, the ones that will work next to Zune too, are labeled "Purchased AAC Audio File".
