My Plasma tv was broken at delivery and electronics store won't pay?
I think it's highway robbery and told Panasonic to go back to their dealer and make good. Through no fault of my own I now own a broken plamsa TV. Panasonic and other dealers must instruct their delivery organization to open the box at the time of delivery so this won't happen again!

Do you still have the original box with all it soft packing? If not, you have no case. If the box shows signs of damage it's still a crap-shoot, since nobody can prove where or when the damage took place. If the box shows no damage, you might have a case to claim hidden damage. Why did you wait 45 days? I have sold and repaired TV sets for folks having house renovations done. We simply hold the item until the customer is ready for it. Fry's probably does not offer that service. This is also a great case for my argument that says, never buy a set from the box. When you get the set from the box, it has not had time to be "run-in" and properly adjusted. I advise folks to buy from the display floor, since these sets have been run-in and adjusted. I have seen sets come straight from the box, dead as a hammer!
I fully relate to what you are going through, but honestly I would never ever let the delivery service guys leave without first checking to see that it is in good shape, or I would never let it sit unopened for 45 days without ever checking it once. I am the kind of person who makes sure she opens any dvd jewelcase at Blockbuster's to make sure the dvd is not damaged enough to make me have to go back and exchange it because I cannot view it. It is our responsibility as consumers to make sure we get our goods in good shape, a plasma tv is not exactly cheap. Delivery boys are just delivery boys, sometimes they have many deliveries to make in a single day and people take the boxes unopened because they will check them later, but later means maybe the next day, not 45 days later. You might sound gullible but it would be more honest to say that you had absolutely no reason to believe your tv was not in perfect shape. It is not the delivery boy's responsibility to open the box since only the customer can do that.
Call your better business bureau, see what they can tell you. Also, I have found out that by being really nice to the dealer you can get a more favorable response than just trying to bend their arm backwards. Tell them you are a customer and that you value their shop and that you actually trusted the goods would be in fine shape and you never imagined something like that could possibly happen because the box was not damaged, and since you were renovating you did not want to expose the tv to dust, etc. if you purchased it with a credit card sometimves they do have some policies that might help you, but the more you yell and behave offensively the less they will be willing to help you. Tell Panasonic the same thing and how much you value their products. A little honey goes a looooong way.
Your only fault was not taking the time to open the box before the 30 days were up.

How can you PROVE that no one threw something at it and broke it? You can't. It's your word against theirs. They were decent enough to give you 30 days. Don't blame Panasonic either. You only have yourself to blame.
If you're looking for sympathy, it's between sh*t and syphilis in the dictionary.
But look on the bright side... you learned something (maybe). Next time, I recommend you inspect things that you pay for.
